Hiring Abroad: Tax, Compliance, and Payroll Basics
This is general information, not legal, tax, or immigration advice. Cross-border hiring involves rules that vary by country, role, and engagement model. Always confirm specifics with qualified counsel or a licensed Employer-of-Record before acting.

The three questions to answer first
- Where will the person be physically located when they do the work?
- Does your company already have a compliant way to employ someone in that location?
- What is the nature of the engagement — employee or contractor?
Employer of Record, briefly
An Employer of Record is a compliant legal employer in a country where you do not have an entity. They employ the person on your behalf and handle payroll, statutory contributions, and required filings. You direct the work.
Contractor classification — read the rules
Many jurisdictions have specific tests for when a working relationship is genuinely a contractor engagement versus a de facto employment relationship. Misclassification is expensive when it is caught. When in doubt, speak with counsel in that jurisdiction before engaging.
Where to find qualified help
For anything more specific than orientation, use a qualified employment lawyer in the jurisdiction, a licensed EOR provider, or a tax advisor with cross-border experience. Do not rely on generic articles — this one included — for a decision that carries statutory risk.
